JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-09-2019 This application, for grant of anticipatory bail, arises out of Laxmipur P.S. Case No. 98 of 2017, disclosing offences under Sections 121(A), 122, 120(B), 427, 431 of of the Indian Penal Code.

Prosecution case is that police got information that some Maoists have set the mobile tower and generator on fire reached there and found the same in ablaze condition and on confidential information name of the petitioner transpired. Submission of learned counsel for the petitioner is that he has no criminal antecedent and has falsely been made accused in this case and further, there is no mentioning as to how the name of petitioner transpired in this case and petitioner is ready to abide by any condition imposed on him for grant of anticipatory bail.

Having heard both sides, in view of the above facts, let petitioner surrender before the court below within two weeks from the date of receipt of this order, on which, he will be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui, in connection with Laxmipur P.S. Case No. 98 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
