JUSTICE SANJAY PRIYA ORAL ORDER 26-02-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends her arrest in Muffasil P.S. Case No. 111 of 2017 instituted for the offence under Sections 420, 467, 471 and 120(B) of the Indian Penal Code. Allegation against the petitioner is that he got appointment as Panchayat Teacher on the basis of forged certificates. The order was passed by this Hon'ble High Court in Public Interest Litigation case vide CWJC No. 15459 of 2014 to enquire about the appointment of teachers on the basis of forged certificate in the year 2006.

Learned counsel for the vigilance has appeared and

Patna High Court Cr.Misc. No.1548 of 2018 (3) dt.26-02-2018 2/3 submitted that there was specific period mentioned in the order passed by this Hon'ble High Court for tendering resignation, but this petitioner has tendered his resignation after expiry of aforesaid period.

Learned counsel for the petitioner has submitted that petitioner has already resigned from his service. It has further been submitted that other co-accused persons with similar allegation have already been granted anticipatory bail by this Court vide orders dated 17.10.2017, 18.12.2017, and 07.12.2017 passed in Cr. Misc. Nos. 42805 of 2017, 55145 of 2017, and 53717 of 2017 respectively and by coordinate Bench of this Court vide order dated 22.09.2017 passed in Cr. Misc. 40824 of 2017 Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today, in connection with Munger Muffasil P.S. Case No. 111 of 2017, she shall be released on anticipatory bail on furnishing bail bond of Rs.

10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Munger, subject to the conditions as laid down under Section 438 (2) Cr. P.C.

Patna High Court Cr.Misc. No.1548 of 2018 (3) dt.26-02-2018 3/3 immovable property within the jurisdiction of the court concerned, (2) petitioner shall cooperate in the trial and shall be present on each and every date fixed by the court and his absence on two consecutive dates without proper and reasonable reason will be liable to cancel his bail bond and (3) if petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.

The authority will be at liberty to take appropriate step for recovery of the amount if so advised, which has been paid to the petitioner in the event he has overstayed and has tendered resignation after the deadline given by the Hon'ble Court. (Sanjay Priya, J) S.Ali/- U T
