The petitioner is in custody since 17.06.2013 in a case for the offence registered under Sections 302/201/34 of the Indian Penal Code.

It is submitted on behalf of the petitioner that the present case been lodged at the instance of the Chowkidar, who on mere suspicion has lodged the present case against the petitioner. It is further submitted that the body was cremated

Patna High Court Cr.Misc. No.9035 of 2014 (5) dt.02-03-2015 2/2 after due information to the Naihar people, but merely because the neighbours have not been informed about the occurrence, suspicion was raised that the woman in question has been done to death.

Considering the nature of allegations and the materials in the case diary and also the period of custody, let the petitioner, above named be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Sikrhana, Motihari in connection with Dhaka P.S.
