JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-07-2019 This is an application for grant of anticipatory bail in connection with Ahiyapur P.S. Case No. 835 of 2018, disclosing offences under Sections 379, 384, 386 498A of the Indian Penal Code.
Allegation against the petitioner is that he has taken the Scooty of the informant/complainant, who happens to be his wife and not returning the Scooty to her.
Submission of learned counsel for the petitioner is that earlier a case under Section 498A of IPC has been filed against the petitioner, in which he is on police bail, thereafter, the present case has been lodged, making false allegation against him.
Heard learned A.P.P. as well as learned counsel for the opposite party no.2 also, they have opposed the prayer for anticipatory bail on the ground that the Scooty is still at the

Having heard both sides, considering the above submissions, let the petitioner, above named, surrender before the court below by 26.07.2019 and on surrender, he will be released on bail to the satisfaction of the learned court below with condition that he is to appear before the I.O. and he will co-operate in the investigation, otherwise, the prosecution is at liberty to move for cancellation of the bail bonds of the petitioner.
