====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 02-12-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Makhdumpur P.S. Case No. 460/2019 registered for the offences punishable under Sections 366/34 of the Indian Penal Code.

As per prosecution case, this petitioner is alleged to have kidnapped the daughter of the informant for the purpose of marriage.

It is submitted on behalf of the petitioner that the victim girl in her statement recorded under Section 164 Cr. P.C. has negated completely the prosecution case and stated that the petitioner has been falsely implicated by her mother in this case and no such occurrence has taken place as she is living in Patna

Patna High Court CR. MISC. No.29047 of 2020(2) dt.02-12-2020 2/2 out of her own will. It is further submitted that the girl is about 19 years of age and the petitioner has no criminal antecedent as stated paragraph No. 3 of the petition.

Considering the aforementioned facts and circumstances, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Jehanabad, in connection with Makhdumpur P.S. Case No. 460/2019, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
