JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-08-2018 Heard the parties. The petitioner seeks anticipatory bail in connection with Bodh Gaya P.S.Case No. 233 of 2018, registered for offences punishable under Sections 409, 406, 420, 120 (B), 467, 468 and 471 of the Indian Penal Code.
As per F.I.R., allegation against the petitioner, who happens to be Principal of College and the informant is employee of the college, is that the principal is of withheld the salary of the informant and diverted the money in the account of his own sister, namely Sudha Kumari by way of illegal and irregular means.
Submission of the learned counsel for the petitioner is that the petitioner is the former Vice-chancellor of Kameshwar Singh Darbhanga Sanskrit University, Darbhanga and the
Patna High Court Cr.Misc. No.47779 of 2018 (2) dt.20-08-2018 2/2 informant had already been dismissed from the post of office Assistant due to irregularity, committed by him. It is also submitted that earlier the petitioner was made accused in other cases also in which he has been granted Anticipatory bail ( A11/A) by the court below. Learned A.P.P. opposes the prayer for bail.
Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioner, above named on surrender or arrest within six weeks be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Bodh Gaya P.S.Case No. 233 of 2018, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court and the petitioner shall cooperate in the investigation made by the police and make himself available as and when required by the police and on the event of failure on his part to appear, his bail bond shall be cancelled.
