This application for anticipatory bail arises out of Kashichak P.S. Case No. 164 of 2019, disclosing the offence punishable under Section 307 and other allied Sections of the Indian Penal Code.

There is direct allegation against the petitioner of having hit the victim in his head with a hockey stick. The victim, according to the injury report, sustained grievous injuries in his head, caused by hard and blunt substance. Allegedly, all the named accused persons brutally assaulted the victim in his head.

Considering the specific nature of allegation against the petitioner, I am not inclined to grant him privilege of anticipatory bail.

This application is accordingly rejected.

No.30782 of 2020(5) dt.19-02-2021 2/2 However, the petitioner is directed to surrender before the Court below within eight weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered on its own merit without being prejudiced by rejection of the present application for grant of anticipatory bail by this Court.
