The petitioners apprehend their arrest in connection with Kudhani P.S. Case No. 543 of 2018 registered for the offences under Sections 364, 504, 302, 120(B) and 34 of the Indian Penal Code and Section 27 of the Arms Act. Allegation against the petitioners and other accused persons is that they have forcibly lifted the deceased and thereafter, dead body was found.

Submission of the learned counsel for the petitioners is that they have falsely been implicated in this case and they have no motive to kill the deceased.

Patna High Court CR. MISC. No.28531 of 2019(3) dt.24-07-2019 2/2 In the facts and circumstances of the case, I am not inclined to grant privilege of anticipatory bail to the petitioners. Accordingly, the prayer for anticipatory bail of the petitioners is rejected. However, the petitioners are directed to surrender before the court below and make prayer for regular bail, the same shall be considered by the learned trial court on its own merit, without being prejudiced by the order of this Court.
