The petitioner seeks pre-arrest bail in connection with Ghosi P.S.Case No. 6 of 2017 registered under Sections 447, 341, 323, 324 and 307/34 of the Indian Penal Code. It is contended by the learned counsel for the petitioner that on completion of investigation the police had submitted charge-sheet under Sections 447, 341, 323 and 504 read with 34 of the Indian Penal Code but differing with the police report, the learned Magistrate took cognizance of the offences punishable under Sections 447, 341, 323 and 307 read with 34 of the Indian Penal Code against all the accused persons. He submitted that from the impugned order itself it would be manifest
Patna High Court Cr.Misc. No.1023 of 2018 (2) dt.17-01-2018 2/2 that all the injuries found on the person of the informant were simple in nature.
Learned counsel for the State opposed the application for grant of pre-arrest bail of the petitioner. Regard being had to the submissions made above, the petitioner, who is said to be a man of clean antecedent, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Jehanabad in connection with Ghosi P.S.Case No. 6 of 2017, in the event of his arrest or surrender before the court below within four weeks from today, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
