JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 21-12-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State, through Video Conferencing. The petitioner seeks bail in connection with Sandesh P.S. Case No.29 of 2019 registered under Sections 394 and 307 of the Indian Penal Code besides Section 27 of the Arms Act. Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that on the basis of the fardbeyan of the informant Ashok Prasad, the present case was instituted against four unknown on 09.02.2019. In course of investigation, the name of the petitioner surfaced in this case in the confessional statement of Nagesh Yadav. Except that, nothing could be collected by the Investigating Officer of the case against the petitioner during investigation. In fact, the

No.31739 of 2020(4) dt.21-12-2020 2/2 petitioner is accused in five other cases, as detailed in paragraph-3 to this application, due to that reason, the police managed to implicate the petitioner in the present case. More so, Nagesh Yadav, in whose confessional statement, the name of the petitioner surfaced in this case, has already been granted bail by a Bench of this Court vide order dated 26.08.2019 passed in Criminal Misc. No.52127 of 2019. The petitioner, in the present case, is in custody since 19.03.2020. Learned counsel for the petitioner submitted at the Bar that the petitioner, who is also accused in five other cases, as detailed in paragraph-3 to this application, is on bail in all the aforesaid five cases.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Bhojpur at Ara, in connection with Sandesh P.S. Case No.29 of 2019.
