2. The petitioner seeks regular bail in connection with Bairiya P.S. Case No. 157 of 2023 for the offences registered under Sections 413, 414 of the Indian Penal Code.
3. As per the prosecution case, motorcycle of the informant was stolen by co-accused Angad Kumar when he had come in e-kisan Bhawan, Bairiya for attending Kisan Chaupal meeting and parked his motorcycle.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from possession of the petitioner. His name has come on the basis of confessional statement of co-accused Angad Kumar. No Test Identification
Patna High Court CR. MISC. No.34421 of 2024(2) dt.17-05-2024 2/2 Parade has been conducted in this case. Petitioner has two criminal antecedents in which he is on bail. He is in judicial custody since 06.02.2024.
5. Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner.
6. Considering the submissions made on behalf of the parties, facts and circumstances of the case and period of custody, let the petitioner, named above, be enlarged on bail upon furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned concerned Court where the case is pending in connection with Bairiya P.S.
