JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 23-11-2020 Heard learned counsel appearing on behalf of the petitioners and learned counsel appearing on behalf of the State. The petitioners are in custody in connection with Ramgarh (Nuaon) P.S. Case No.103 of 2020 for the offence under Sections 147, 148, 149, 341, 323, 325, 307, 447, 504 and 506 of the Indian Penal Code and Sections 27 and 30 of the Arms Act.

Learned counsel appearing on behalf of the petitioners submits that the petitioners have no criminal antecedents. He further submits that there is no specific allegation of overt act of firing against the petitioners. Petitioners are in custody since

Patna High Court CR. MISC. No.30561 of 2020(2) dt.23-11-2020 2/2 20.05.2020 and 22.5.2020, respectively.

Considering the fact that the petitioners are members of the unlawful assembly involved in the commission of crime and there is no specific allegation of overt act of firing against the petitioners, the Court is inclined to grant bail to them. The petitioners, named above, are directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) each with two sureties of the like amount each to the satisfaction of I/C A.C.J.M.-1, Kaimur at Bhabua in connection with Ramgarh (Nuaon) P.S. Case No.103 of 2020.
