It is submitted by the counsel for the State that the petitioner's claim for promotion from the post of Assistant Commissioner of Commercial Taxes to the post of Joint Commissioner of Commercial Taxes has been denied on the ground of pendency of criminal case against him. He submits that the petitioner has superannuated on 31st January 2014. Records reveal that on 05.03.2014 when the petition was admitted none had appeared for the petitioner. Even today none has appeared on behalf of petitioner.
