2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 147, 148, 149, 341, 323, 307, 461, 427, 504, 506, 302 of the Indian Penal Code.
3. As per prosecution case, some anti-social elements broke the lock of shop of the informant and took out all articles from the shop and they kept their own articles in the shop. When the brother of the informant Sadad Ilyas inquired about it, then the accused persons including some uknown assaulted Sadab Ilyas with rod and hammer and injured him. Sadab Ilyas died during course of treatment on 31.1.2023.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is not named in the FIR. His name came into light on the basis of CCTV footage. No any consistent evidence has come against the petitioner during course of investigation. It is further submitted that the petitioner is languishing in judicial custody since 9.1.2024. Moreover, similarly situated co-accused Aman Kumar has already been enlarged on bail by this Court vide order dated 17.5.2024 in Cr. Misc. No. 37685 of 2024.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody period, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Sanhaula P.S. Case No. 156 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Bhagalpur.
