The petitioners have prayed for regular bail in a case instituted for the offence under Sections 120B, 420, 406, 467 and 468 of the Indian Penal Code.

No.29364 of 2023(4) dt.23-08-2023 2/3 As per allegation in the FIR, the informant alleged in his complaint petition that he and other witnesses have joined in the Financial Company Waris Fonance International Ltd. As an agent and got deposited the money of different customer in the different schemes and altogether Rs. 1,61,84,000/- (Rupees One Crore Sixty One Lac Eighty Four Thousand only) was deposited in the company in different schemes but after maturity no payment was made to any one.
It is submitted by learned counsel for the petitioners that petitioners have been falsely implicated in this case. Petitioner Ruhi Gazala Warsi is neither member of Board of Director nor in any manner related with the affairs of the company. She is only wife of the Managing Director. It is further stated that entire movable and immovable property of the companies has been seized by the authority and Hon'ble Justice S.P. Talukdar one man committee has been constituted for the auction of the property and it will be paid to the investor of the company. A copy of the same is brought on record as Annexure-A by way of filing supplementary affidavit. Similarly situated other accused persons have already been enlarged on bail by another coordinate Bench of this Court vide order dated 23.6.2017 passed in Cr. Misc. No. 12991 of 2017 and vide order dated 17.10.2017 passed in Cr. Misc No. 47936 of 2017. Both the petitioners are languishing in judicial custody since 26.11.2022

The application for bail is opposed by learned APP for the State.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned CJM, Munger in connection with Jamalpur PS Case No. 165 of 2014.
