2. The petitioners are named in the Complaint case and apprehending their arrest in connection with Complaint Case No. 1694C of 2024 registered for the offences punishable under Sections 85 of BNS.

3. As per complaint, petitioner alleged to commit mental and physical cruelty upon complainant/

4. It is submitted by learned counsel appearing on behalf of the petitioners that the thrust of allegation is available against the husband namely, Md. Afjal with whom O.P. No. 2 solemnized her marriage out of love affairs. It is submitted that the marriage of O.P. No. 2 with her husband, namely, Md. Afjal was registered under Special Marriage Act and they are living separately. It is submitted that both Md. Afjal and O.P. No. 2 are government employee and these petitioners implicated only being relative of Md. Afjal, who are not even remotely connected with daily and domestic affairs of O.P. No. 2 and her husband. Petitioners claimed clean antecedent.

5. Learned APP duly assisted by learned counsel for the informant while opposing the prayer of bail could not disputed the fact that O.P. No. 2 solemnized her marriage under Special Marriage Act with her husband out of love.

In view of aforesaid factual submission and by taking note of fact as petitioners are in-laws primafacie facing general and omnibus allegation of mental and physical cruelty, accordingly all above-named petitioners, in the event of their arrest or surrender before the court below within a period of four weeks, are directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM, Teghra, Begusarai /concerned Court, where the case is pending in connection with Complaint Case No. 1694C of 2024, subject to the conditions as laid down under Section 482(2) of BNSS.
