Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner seeks bail in Barhara P.S. Case No. 152 of 2020, registered for the offence punishable under Section 395 of the Indian Penal Code.

Earlier the bail application of petitioner was rejected vide order dated 18.03.2021. Vide order dated 11.08.2021, report was called for regarding the stage of trial and same has been received (kept at flag 'X'), which reveals that case has already been committed to the court of Session for compliance of Section 207 of Cr.P.C.

Considering the nature of accusation and the stage of

Patna High Court CR. MISC. No.40233 of 2021(3) dt.22-09-2021 2/2 trial, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected.

As the petitioner is in custody since 01.12.2020 having clean antecedent, trial court is directed to conclude the trial as early as possible.
