The petitioner has prayed for regular bail in a case instituted for the offence under Sections 342, 324, 326, 307, 379/34 of the Indian Penal Code.

The allegation against the petitioner is of assaulting by means of knife to the informant, due to which he sustained injury.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. He has committed no offence. The petitioner and informant are close relative and due to that petitioner was working in the shop of the informant as a staff. From the perusal of the injury report, which is annexed as annexure-2 with the petition, the doctor found all

Patna High Court CR. MISC. No.31432 of 2023(2) dt.24-06-2023 2/2 the injuries caused by this petitioner, are simple in nature. Petitioner has got no criminal antecedent as stated in para-3 of the bail petition. He is languishing in judicial custody since 22.08.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as period of custody, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge, Danapur (Patna) in connection with Khiri More P.S. Case No. 85 of 2022.
