2. The petitioners are apprehending their arrest in Dumariya Ghat P.S. Case No. 19 of 2024 registered under Section-302, 34 of the Indian Penal Code.
3. According to FIR, marriage of daughter of the informant was solemnized with Chandan Kumar in the year, 2012. In absence of Chandan Kumar, the petitioner committed murder of the deceased by strangulating her throat.
4. It has been submitted on behalf of the petitioners that they are family members of husband of the deceased. Her

No.29123 of 2025(4) dt.30-10-2025 2/3 husband was residing in Bangalore and during conversation on mobile, the couple were quarrelling and this fact transpires from the statements of the independent witnesses made in paragraphs31 & 32 of the case diary. Her husband was not sending money for her expenses and that is why, due to mental depression, she committed suicide, which fact is clear from the postmortem report which shows that no external injury was found on the dead body of the deceased and the cause of death is due to asphyxia. Learned counsel has also submitted that the petitioners are agnates of husband of the deceased and there is partition between the husband of the deceased and the petitioners with metes and bounds and they are residing in their separate portion of the houses.
5. Learned APP has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of four weeks, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari in connection with
Patna High Court CR. MISC. No.29123 of 2025(4) dt.30-10-2025 3/3 Dumariya Ghat P.S. Case No. 19 of 2024, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure/482(2) of the BNSS.
7. It is made clear that the petitioners will appear in the court below on each and every date fixed in the case till framing of charges.
