JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 16-05-2024 Heard learned counsel for the petitioners and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 366(A)/34 of the Indian Penal Code.

It is a case of commission of kidnapping of the minor daughter of the informant by all the accused persons including the petitioner.

It is submitted by learned counsel for the petitioners that petitioner is innocent and she has falsely been implicated in this case. The informant is not the eye witness to the occurrence and merely on suspicion,

There is no specific allegation against the petitioner and no any active role in this case. Moreover, the petitioner is 24.01.2024 languishing in custody since 26.05.2023. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Similarly situated co-accused namely, Raushan Kumar and Raja Kumar have been granted bail vide order dated 02.11.2023, passed in Cr. Misc. No. 55682 of 2023 by this Court.

In contra, learned A.P.P appearing on behalf of the State have vehemently opposed the prayer for bail of the petitioner.

Considering the facts aforesaid and the period under custody, let the petitioner, above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Gogari P.S. Case
