JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 08-08-2018 The present application has been filed for modification of the order dated 23.02.2012 passed in Cr. Misc. No. 5293 of 2012 to the extent of extending the period of surrender.

The petitioner being the Secretary and coaccused Thakur Pradip Singh have misappropriated the funds and did not return Godrej almirah and Singer sewing machine. On submission that the petitioner is ready to return Godrej almirah and Singer sewing machine, he was granted anticipatory bail vide order dated 23.02.2012 passed in Cr. Misc. No. 5293 of 2012. Subsequently, the order was modified vide order dated 09.05.2012 passed in Cr. Misc. No. 17918 of 2012, whereby the learned Court below was directed to accept the bail

Patna High Court Cr.Misc. No.47220 of 2018 (2) dt.08-08-2018 bond of the petitioner on return of the articles which are alleged to have been given to the petitioner for repair. It is submitted by learned counsel for the petitioner that the petitioner was suffering from cardiac problem and he was operated upon at Medanta Hospital, Gurgaon, Haryana, hence, he could not surrender and furnish bail bond. On the grounds mentioned in the modification application, the period of surrender is extended by three weeks from the date of receipt/production of a copy of this order in connection with Laheri P.S. Case No. 101 of 2011, pending in the Court of learned A.C.J.M.- 1st, Nalanda at Biharsharif. The other conditions will remain the same as has been incorporated in order dated 23.02.2012 passed in Cr. Misc. No. 5293 of 2012. It is made clear that no further modification application will be entertained.

Accordingly, this modification application is disposed of.
