JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-07-2019 This is an application for grant of anticipatory bail in connection with Ekangarsarai P.S. Case No.54 of 2019, disclosing offences under Section 420 of IPC and 7 of Essential Commodities Act.

Allegation against the petitioner is that several shortcomings was found while his shop was inspected and there was a complaint also not supplying the articles to the consumers and in Bhadar Panjiri it has been shown as Zero. Submission of the learned counsel for the petitioner is that without waiting for show cause to be filed by the petitioner, the present case has been lodged and paras 6, 7 & 8 also disclosed that the allegations are false and concocted. Heard learned A.P.P. also who has opposed the prayer for bail stating that materials collected during the course of

Patna High Court CR. MISC. No.29823 of 2019(3) dt.18-07-2019 2/2 investigation also support the prosecution case. Having heard both sides, in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner may move before the learned court below for regular bail which will be considered by the learned court below on the basis of materials available on record, and if possible, be disposed of on the same day.
