====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-01-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 307 and other allied sections of the Indian Penal Code and sections 25(1-B)a, 26/27 and 35 of the Arms Act and under the Explosive Substances Act . Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. FIR was lodged against co-accused Balendra Rai and 47 others except the petitioner. He has not been arrested on the spot nor any incriminating material has been recovered from the conscious possession of the petitioner. Petitioner's name has figured during course of investigation in confessional statement of co-accused. Petitioner is in custody since 16.1.2020.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the rival submissions of the parties, materials available on the record and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, West Muzaffarpur in Motipur Police Station Case No. 139 of 2002.
