1. Heard learned counsel for the petitioners and learned APP for the State.

2. The learned counsel for the petitioners submits that a complaint case came to be instituted against the petitioners by the O.P. No. 2, the trial court based on the material which transpired during the course of inquiry, was pleased to dismiss the complaint case.

3. The learned counsel next submits that the O.P. No. 2 herein moved in revision against the order of dismissal of the complaint, but the revisional court without issuing notice to the O.P. No. 2 set aside the order passed by the learned trial court

Patna High Court CR. MISC. No.61963 of 2017(2) dt.19-12-2023 2/2 dismissing the complaint case and remanded the matter back to the trial court for deciding afresh based on which cognizance came to be taken. It is further submitted that the petitioners have challenged the order of cognizance which was taken in pursuance of the remand by filing Criminal Miscellaneous No. 56465 of 2017.

4. At this stage, the learned counsel for the petitioners seeks permission to withdraw the quashing application.

5. Permission is accorded.

6. Accordingly, the present quashing application stands dismissed as withdrawn.
