2. The petitioner has prayed for bail in connection with Harnaut P.S. Case No.716 of 2023 registered for the offence punishable under Sections 395 and 397 of the Indian Penal Code.

3. The case of the prosecution is that six accused persons from two bikes looted 57,000/- and a mobile phone on gun point and also assaulted with butt of the pistol. It is further alleged that the accused persons were aged about 20-30 years. It is also submitted that the FIR was lodged against the unknown miscreants. During the course of investigation, one Sujit Kumar apprehended and the name of this petitioner has surfaced only on the confessional statement of Sujit Kumar, nothing has been recovered from the possession of this petitioner. The learned counsel for the petitioner has also submitted that Sujit Kumar on

Patna High Court CR. MISC. No.30246 of 2025(2) dt.19-05-2025 2/2 whose confessional statement name of this petitioner has surfaced has been granted bail by a co-ordinate Bench of this Court vide Cr.Misc.No.929 of 2025. The case of this petitioner stands on similar footing.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. Petitioner is languishing in judicial custody since 20.08.2024.

5. The application for bail is opposed by learned APP for the State and submitted that this petitioner is having criminal antecedent of four cases and he is on bail in all the said cases.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge, Nalanda at Biharsharif in connection with Harnaut P.S. Case No.716 of 2023.
