The petitioner apprehends his arrest in Govindganj P.S. Case No. 218 of 2016 registered under Sections 366(A), 323 and 504/34 of the Indian Penal Code.
The informant alleged that the petitioner being brother-in-law of the informant came to the house and took his younger and minor sister, Mithilesh Kumari, to look after her elder sister (wife of the petitioner), but when the informant went to the house of the petitioner, the younger sister of the informant was not found inside the house. The informant further alleged that the petitioner took away his minor sister for the purpose of marriage.
Patna High Court Cr.Misc. No.57379 of 2017 (2) dt.03-01-2018 2/2 Learned counsel for the petitioner submits that the victim made her statement under Section 164 of the Cr.P.C. and she disclosed that she wants to marry with the petitioner. The first wife of the petitioner is also ready to get the petitioner married with her younger sister.
Considering the fact that there is specific allegation that the petitioner enticed his minor sister-in-law, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
