The petitioner apprehends his arrest in Gopalganj Town P.S. Case No. 376/2017, instituted for the offences punishable under Sections 406, 420, 467, 468 and 471 of the Indian Penal Code.

It is alleged in the written report that the informant is a poor labourer. At the instance of Shamim Ahmad, PACS Chairman, he got opened PACS Bank Account bearing no. 138 in Central Co-operative Bank Ltd. and deposited Rs. 1,02,250/- in the aforesaid account and also deposited Rs. 2,75,000/- as Fixed Deposit. The Bank avoided to make payment of the mature amount and when he went to the Bank, then he found that Bank

Patna High Court Cr.Misc. No.36078 of 2018 (3) dt.24-07-2018 2/2 has been closed and money has been misappropriated by the accused persons including this petitioner. It has also been mentioned in the written report that all the accused persons including the petitioner have misappropriated the money of about two thousand persons and photocopy of passbook of 500 people have been enclosed with the F.I.R.

Case diary has been received.

Learned Additional P.P. has opposed the prayer for anticipatory bail of the petitioner and submitted that the aforesaid allegation is supported by many witnesses during course of investigation.

Accordingly, the anticipatory bail petition of the petitioner is rejected.

The petitioner may surrender before the court below and seek regular bail, which shall be considered by the court below in accordance with law without being prejudiced by this order.
