JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 28-01-2016 By way of the present application preferred under Articles 226 and 227 of the Constitution of India, the petitioners seek quashing of the first information report in connection with Narpatganj P.S. Case No.46 of 2015 registered under Section 366A read with 34 of the Indian Penal Code.
A perusal of the FIR would make it evident that it attracts ingredients of a cognizable offence. However, at the outset, learned counsel for the State has submitted that he has received instructions from the Superintendent of Police, Araria that in the aforesaid police case
Patna High Court Cr. WJC No.336 of 2015 (2) dt.28-01-2016 2/2 on completion of investigation a report under section 173(2) of the Code of Criminal Procedure has already been submitted in the court way back in May, 2015.
In view of the subsequent development which took place during the pendency of the present application, learned counsel for the petitioners seeks leave to withdraw this application. Leave is granted.
The application is disposed of.
