The petitioners apprehend their arrest in connection with Kahalgaon P.S. Case No. 195 of 2017, registered for the offences punishable under Sections 147, 353, 332, 337, 338, 427, 379 and 511 of the Indian Penal Code.
The informant alleged that the petitioners and others pelted stones on the police party while they were escorting coal rake from TPS Kahalgaon to Kahalgaon Railway Station.
Learned counsel for the petitioners submits that no specific allegation is made against the petitioners. On similar facts, other co-accused persons, namely, Pankaj Mandal and Rajesh Mandal, have already been granted
Patna High Court Cr.Misc. No.56983 of 2017 (2) dt.18-12-2017 2/2 anticipatory bail vide order, dated 03.10.2017, passed in Cr. Misc. No. 46429 of 2017. The case of these petitioners stands on same footing.
Considering the facts aforesaid, the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur, in connection with Kahalgaon P.S. Case No. 195 of 2017, subject to the conditions as laid down under Section 438(2) of the Criminal Procedure Code.
