Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P. for the State. The petitioner seeks bail in a case for the offence registered under Section 304(B)/34 of the I.P.C. The prosecution story, in brief, is that accused persons including the petitioner killed the victim due to non-fulfilment of demand of dowry.
It has been submitted by learned counsel for the petitioner that the petitioner is in custody since 15.06.2020. Charge sheet has been submitted in the present case. There is no
Patna High Court CR. MISC. No.29708 of 2020(3) dt.11-01-2021 2/2 allegation of tampering with the witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The petitioner is a co-villager of the husband of the deceased. She has got no concern with the alleged occurrence. For petty reason, the petitioner has been made accused in the present case. The petitioner is a lady. On behalf of the learned counsels for the State and the informant, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-15, Vaishali at Hajipur, in connection with Desri P.S. Case No. 48/2020.
