JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-07-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No.1287C of 2017 disclosing offences under Sections 342, 323, 325, 307, 34 of IPC. Allegation as per complaint petition is that while the complainant was coming back from attending the call of nature, all the petitioners came and assaulted, causing fracture of his left leg.

Submission of the learned counsel for the petitioners is that no specific allegation has been attributed against any of them and the injuries at the leg, which is not vital part of the body.

Patna High Court CR. MISC. No.30116 of 2019(3) dt.18-07-2019 2/2 Heard learned A.P.P. as well as learned counsel for the complainant also, they have opposed the prayer for anticipatory bail on the ground that earlier they have also assaulted the complainant and the Panches was imposed a fine of Rs.1100/- and also make a bond of Rs.25,000/-. Further submission is that they have assaulted the complainant and injury was found to be grievous in nature.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Sri Balednra Sukla, A.C.J.M.-V, Begusarai, in connection with Complaint Case No.1287C of 2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
