JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 17-11-2022 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 379, 504, 506, 354, 448, 427, 326/34 of the Indian Penal Code.

The prosecution case as per F.I.R is that all the accused persons including petitioner, variously armed came to the house of the informant and started assaulting the informant's husband and when the informant came to his rescue, she was also assaulted by the accused persons. It is specifically alleged against the petitioner that he assaulted with Garasa on the head of the informant's husband, as a

It is further alleged that co-accued Lallan Sah assaulted the informant's husband by Garasa and wife of petitioner snatched golden ornaments of the informant. Allegation against co-accused Vanshi Sah is that he outraged the modesty of the informant.

It is submitted by learned counsel for the petitioner that in the background of some dispute, the present F.I.R has been registered. There is counter version of the occurrence also and petitioner's side also received injuries. There is no accusation of repeating the blow. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Kaimur, Bhabua in connection with Ramgarh P.S. Case No. 15 of
