Petitioner seeks anticipatory bail in Piprahi P.S. Case No.119 of 2017 instituted for the offence under Sections 307, 120(B)/34 of the I.P.C. and Section 27 of the Arms Act. Informant, Bikash Kumar Singh, in his F.I.R. has alleged that on 21.08.2017 at 7.30 P.M. when he was sitting in his Spare Parts Shop suddenly two persons came on motor cycle and pillion rider, namely, Vijay Ram opened fire on the informant which could not hit him and again he fired on him causing injury on his back even then he tried to flee away upon which Vir Bahadur Mahto who happens to be the so called second husband of the wife, namely, Anuradha Singh, of the informant, also fired upon the informant causing injury on his back. No.2466 of 2018 (3) dt.17-02-2018 2/2 Anuradha Singh of the informant has been blessed with two sons, Prem Pushp aged about 13 years and Shubham aged 9 years and thereafter she solemnized marriage with accused no.2 Vir Bahadur Mahto and, as such, he wanted to kill first husband (informant) of his wife to grab his property. Informant was brought to Sadar Hospital for treatment from where he was referred to S.K.M.C.H., Muzaffarpur for treatment.

It has been submitted by the counsel for the petitioner that she is innocent and she has been falsely implicated in this case. She has no criminal antecedent and on the basis of suspicion only she has been named in the F.I.R. without giving her parentage or husband's name merely on suspicion. Considering the facts and circumstances of the case, let the petitioner, above named, in the event of her arrest or surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the C.J.M., Sheohar, in Piprahi P.S.Case No.119 of 2017 subject to the condition as laid down under Section 438(2) of Cr.P.C.
