2. Heard learned counsel for the parties.

The petitioner is aggrieved by the order dated 21.03.2023 passed by the court of learned Munsif-I, Buxar in Title Suit No. 19 of 2017, whereby and whereunder the application filed by the petitioner on 20.12.2018 under Order 6 Rule 17 read with Section 151 of the Code of Civil Procedure has been rejected.

4. After some argument, learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to file a fresh petition before the learned trial court seeking only those amendments which are completely necessary.

5. In the light of submission made on behalf of the petitioner, the present petition is dismissed as withdrawn with

Patna High Court C.Misc. No.523 of 2023(3) dt.09-09-2024 3/3 liberty to the petitioner to file fresh application and the learned trial court is directed to dispose of the same strictly within the four corners of law.
