What has been impugned in this application is a notice issued to the petitioner and his brother by the respondent Circle Officer to explain certain facts and until then to stop any construction. Presumably, it appears the Circle Officer wants a clarification with regard to the government building existing on the land/plot. The petitioner has yet to submit a response enabling the Circle Officer to pass any appropriate order in accordance with law and, if dissatisfied, the petitioner may challenge the same before the appropriate forum/authority in accordance with law. Counsel for the petitioner states that the reply has already been filed, however, no order has been passed.
Patna High Court CWJC No.5431 of 2015 (2) dt.12-02-2016 2/2 Considering the above, this Court disposes of the application by observing that the respondent Circle Officer shall consider the said reply of the petitioner and pass appropriate orders in accordance with law as quickly as possible preferably within three weeks from the date of receipt/production of a copy of this order.
