The petitioner seeks bail in Barhariya P.S. Case No. 14/2019, instituted for offences under Section(s) 420, 467, 468, 379/34 of the Indian Penal Code.

It is alleged in the written report that on getting secret information that near A.T.M. of Canara Bank three persons have assembled, police party reached there and saw three boys were wandering. They started running away on seeing the police party, but on chase two of them were arrested, who disclosed their name as Javed Akhtar and the petitioner. It is alleged that five A.T.M. Cards were recovered from possession of this petitioner.

Learned counsel for the petitioner has submitted that

Patna High Court CR. MISC. No.28803 of 2019(2) dt.06-05-2019 2/2 petitioner has been arrested in this case merely on suspicion. He had gone to withdraw the money from the A.T.M. Centre of Barhariya.

Petitioner is in custody since 12.01.2019.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan, in connection with Barhariya P.S. Case No. 14/2019, subject to the conditions that both the bailors shall be the close relative of the petitioner.
