The petitioner seeks bail in Narpatganj P.S. Case No. 109 of 2019, instituted for the offence under Section(s) 413 and 414/34 of Indian Penal Code.

It is alleged in the written report that informant got secret information that some miscreants came in market to sell and purchase stolen Motorcycles. The informant along with Police personnel went there. They saw one Apache Motorcycle coming towards Panchayat Bhawan, on which two persons were seated. On seeing the Police party, they started running away. On chase, they were apprehended by the Police. They disclosed their names as Rajesh Kumar (petitioner) and Amod Kumar Yadav. Patna High Court CR. MISC. No.28226 of 2019(2) dt.02-05-2019 2/2 aforesaid Motorcycle.

Counsel for the petitioner submits that petitioner has clean antecedent. He has been arrested merely on suspicion. Petitioner was pillion rider. He further submits that no case with regard to aforesaid Motorcycle has been lodged by the owner. Petitioner told before the Police that Motorcycle belonged to Roushan Kumar Yadav. They have taken the Motorcycle from him for going to market.

Petitioner is in custody since 21.02.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria, in connection with Narpatganj P.S.
