Mr.Manoj Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR JHA ORAL ORDER 27-06-2025 Today, learned counsel for the petitioner has filed a hard copy of the petition in this Court, which is taken on record.

2. Heard learned counsel for the petitioner and learned counsel for the State.

3. This application has been filed for modification of the order dated 10.01.2025 passed in Cr. Misc. No.80681 of 2024 by this Court, by which the petitioner has been granted bail with certain conditions.

4. The learned counsel for the petitioner submits that the petitioner has been granted bail vide order dated 10.01.2025 with certain conditions including condition no. (i) 'One of the bailors will be a close relative of the petitioner'. But the

Patna High Court CR. MISC. No.32342 of 2025(3) dt.27-06-2025 2/3 petitioner is still in custody as none of the close relatives of the petitioner is ready to stand surety for her. The learned counsel further submits that a report has been received from the District Probation Officer, Biharsharif, Nalanda wherein she has submitted that the petitioner was a resident of District Begusarai and she came to Biharsharif after fleeing from her house and she was not in contact with either her parents or siblings or any family members. Therefore, there is no relative of the petitioner who can stand surety for the petitioner. The learned counsel prays for waiving the condition no. (I) and for release of the petitioner on her personal bond.

5. Having regard to the submission made on behalf of the petitioner and considering the fact that there appears no close relative to stand surety for the petitioner, the condition no. (i) imposed regarding one of the bailors would be close relative of the petitioner is waived and stands deleted from the conditions. Further, condition of production of two sureties is also modified to the extent that the petitioner is required to produce one surety only.

6. So far as the prayer of the learned counsel for the petitioner about the petitioner being released on personal bond is concerned, the same could not be acceded to and the

7. Accordingly, the order dated 10.01.2025 is modified to the aforesaid extent only.

8. The present petition stands disposed of.
