The petitioner seeks bail in a case registered under Sections 341, 323, 324, 325, 307, 354, 379, 504, 506/34 of the Indian Penal Code.

The prosecution case in short is that while the informant along with his family members was going to plant paddy in his field, all of a sudden, the accused persons appeared on the road having armed and brother of the informant was assaulted, as a result of which, he sustained bleeding injury. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. Patna High Court CR. MISC. No.28850 of 2019(4) dt.15-07-2019 2/2 already been submitted. As per the FIR, the petitioner and the co-accused Krityanand Mahto are alleged to have given farsa blow on the head of informant's brother. As per injury report, there is only one injury. The petitioner has been falsely implicated in the present case. The injury report does not corroborate the allegation made in the FIR.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Narpatganj P.S. Case No. 326 of 2017.
