====================================================== CORAM: HONOURABLE MR. JUSTICE SHAILENDRA SINGH ORAL ORDER 08-08-2025 At the outset it is informed by appellant's counsel that the trial of the appellant has started after framing of charges upon him.

2. It is submitted by learned APP that the instant petition has been filed with a prayer to quash the order dated 23.04.2022 passed by the learned Exclusive Special Court (S.C./S.T.(POA) Act Nawada in special (SC/ST) Case No. 120/17/83/17 arising out of Nardiganj P.S. Case No. 10/14, whereby the appellant's prayer to discharge him under section 227 of Cr.P.C from the alleged offences has been rejected and now the appellant's trial has started, so, in view of this position the instant petition should be treated as being infructuous.

3. Considering the aforesaid submissions the instant petition stands dismissed as being infructuous however, the appellant will have a liberty to raise all the grounds which he has taken in this petition before the trial court during the course of trial. (Shailendra Singh, J) siddharthkr/- U T
