JUSTICE SANJAY PRIYA ORAL ORDER 29-08-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Complaint Case No. 08 of 2017 instituted for the offence under Sections 420 and 506/34 of the Indian Penal Code.
It is alleged in the complaint petition that complainant and other accused persons opened Bikram Sheela Mutual Benefit. They allured the complainant and said to join the company as an agent and to collect money from the people. The company would give commission and in very short period, money would be doubled. It has further been alleged that complainant deposited Rs.5,38,500/- of different customers including himself in the said

Upon maturity, the customers started making demand of their money, but accused persons did not pay the money. They closed the office and on demand being made, accused persons threatened with dire consequences.
In this manner, from the complaint petition it appears that there is specific allegation against petitioner of misappropriating the amount of several depositors by opening Bikram Sheela Mutual Benefit and when money has matured, the company fled away.
Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.
Prayer for anticipatory bail of the petitioner stands rejected.
Petitioner may surrender before the court below and make prayer for regular bail which shall be considered by the court below in accordance with law without being prejudiced by this order.
