JUSTICE PARTHA SARTHY ORAL ORDER 12-11-2020 Heard learned counsel for the petitioner and learned APP for the State, through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Piro P.S. Case No. 272 of 2019 registered against unknown under section 395 of the Indian Penal Code.

As per allegation in the FIR, six accused persons on two motor-cycles, on the point of arms, looted the informant of his belongings that he was carrying as also his mobile phone and money.

It is submitted by learned counsel for the petitioner that the FIR was registered against unknown and the name of the petitioner transpired on his own confessional statement when he was arrested in connection with one another case. It is

No.25734 of 2020(3) dt.12-11-2020 2/2 submitted that the alleged confessional statement is before police and no recovery of any incriminating article has taken place from the petitioner. The petitioner has not been put on T.I. parade. He is in custody since 16.3.2020 and the investigation in the case with respect to the petitioner has concluded. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the fact that the petitioner is in custody since 16.3.2020 and has not been put on T.I. Parade, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Piro P.S. Case No. 272 of 2019 on furnishing bail bond of Rs. 10,000/ (Rupees ten thousand) only with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara.
