====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 13-10-2020 Heard the learned counsel for the petitioner and the State.

The petitioner seeks bail in anticipation of his arrest in connection with Sasaram (M) P. S. Case No. 377 of 2019 dated 10.12.2019, instituted for the offences under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

Huge quantity of liquor (5366.7 litres) is stated

Patna High Court CR. MISC. No.25662 of 2020(2) dt.13-10-2020 2/3 to have been recovered from a bush by the side of a drain. The petitioner and others are suspected to have brought the aforesaid consignment of liquor for the purpose of selling the same.

The learned counsel for the petitioner submits that it is only on the basis of suspicion that he has been made accused in this case. He is a person of clean antecedents and up till now he has not been made accused in any case whatsoever.

Considering the aforesaid facts, especially of there being no recovery from his personal and constructive possession and his being a person of clean antecedents, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional District and Sessions Judge

Patna High Court CR. MISC. No.25662 of 2020(2) dt.13-10-2020 3/3 - cum - Special Judge, Rohtas at Sasaram in connection with Sasaram (M) P. S. Case No. 377 of 2019, subject to the conditions as laid down under Section 438 (2) Cr.P.C.

The application stands allowed.
