The petitioner was granted anticipatory bail by order dated 18.04.2014 passed by a Bench of this Court in Cr. Misc. No. 54131 of 2013. However, the aforesaid order was subject to the petitioner's surrendering before the Court below within a period of four weeks from the date of passing of the order.

The learned counsel for the petitioner has submitted that since he hails from a remote rural area of Haryana, he could not be communicated the aforesaid order as well as his requirement of surrendering before the Court below within four weeks of passing of the order.

Under the aforesaid circumstances, the petitioner has

Patna High Court Cr.Misc. No.40782 of 2018 (3) dt.25-07-2018 2/2 prayed for modification of the order referred to above granting him some more time to surrender before the Court below.

By way of supplementary affidavit, learned counsel for the petitioner has brought on record the order-sheet of the Court below which indicates that the petitioner has not yet been declared an absconder.

Regard being had to the facts of this case, the order dated 18.04.2014 passed in Cr. Misc. No. 54131 of 2013 is modified to the extent that if the petitioner surrenders before the Court below within a period of four weeks from today, he shall be released on bail on his furnishing bail bonds in the sum of Rs. 5000/-(five thousands) with two sureties of the like amount each to the satisfaction of the Court concerned. The other conditions imposed in the order dated 18.04.2014 shall however subsist.

With the aforesaid modification of the order dated 18.04.2014 passed in Cr. Misc. No. 54131 of 2013, the petition is disposed of.
