1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner is apprehending his arrest in connection with Bihta P.S. Case No. 679/2022 dated 14.07.2022, registered for the offences punishable under Sections 25(1-b)a, 26 and 35 of the Arms Act pending in the Court of learned Additional Sessions Judge-V, Danapur (Patna).

3. After some arguments, learned counsel for the petitioner seeks permission to withdraw this application.

4. Permission is granted.

5. Accordingly, the instant application is dismissed as withdrawn.

6. However, if the petitioner surrenders before the learned Court below within a period of six weeks from today

Patna High Court CR. MISC. No.31355 of 2023(2) dt.17-07-2023 2/2 and seeks regular bail, the learned Court below would pass the order, preferably, on the same day, without being prejudiced by this order.
