====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 09-05-2024 Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners seek bail in connection with Awtarnagar P.S. Case No. 57 of 2024 dated 14.03.2024 registered for the offence punishable under Section 392 of the I.P.C.

3. As per the prosecution case, the informant is doing job of taxi driving. Three unknown accused persons booked his taxi bearing Registration No. BR01PP2454 on 13.03.2024 at 8.00 P.M., and took him from Patna Junction to Dhanaura Bazaar. It is further alleged that as soon as the taxi reached at

Patna High Court CR. MISC. No.33599 of 2024(2) dt.09-05-2024 2/3 the destination of Basbari ahead Dhanaura Bazaar, they stopped the taxi and snatched Mobile No. 6201308429, Rs. 1900/- in cash from the informant and fled away alongwith his taxi.

4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. The petitioners are not named in the F.I.R. The name of the petitioners has sprung up in the present case on the basis of the confessional statement of the co-accused Suman Kumar. No T.I. Parade has been conducted for their identification. No incriminating article has been recovered from possession of the petitioner no. 1. The stolen mobile and purse of the informant have been recovered from the house of the petitioner no. 2. It is further submitted that the taxi of the informant has been recovered from possession of the co-accused Suman Kumar. The petitioners have clean antecedent as stated in paragraph no. 3 of the bail petition. They are in custody in this case since 17.03.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioners.

6. Considering the aforesaid facts and circumstances of the case, the petitioners, above named, are directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees

Patna High Court CR. MISC. No.33599 of 2024(2) dt.09-05-2024 3/3 Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Awtarnagar P.S. Case No. 57 of 2024.
