The only prayer sought for by the petitioner is to direct the Sub Divisional Officer, Sonepur, Saran at Chapra (respondent no. 4) to take into consideration the fact that the criminal case filed against the petitioner, i.e., G.R. Case No. 3100 of 2006 arising out of Dariyapur P.S. Case No. 93 of 2006 has ended in acquittal of the petitioner, therefore, the Sub Divisional Officer may be directed to take necessary decision to restore the public distribution system license of the petitioner bearing no. 100 of 1985.

3. Learned counsel appearing for the respondents has stated that the writ petition may be disposed off directing the

Patna High Court CWJC No.7268 of 2023(2) dt.07-08-2023 2/2 Sub Divisional Officer, Sonepur, Saran at Chapra (respondent no. 4) to consider the case of the petitioner sympathetically duly taking into consideration the fact that the criminal case filed against the petitioner has ended in acquittal.

Having regard to the above made submissions, the writ petition is disposed off with a direction to the Sub Divisional Officer, Sonepur, Saran at Chapra (respondent no. 4) to consider the case of the petitioner for restoration of public distribution system license bearing no. 100 of 1985 duly taking into consideration that the criminal case filed against the petitioner in G.R. Case No. 3100 of 2006 arising out of Dariyapur P.S. Case No. 93 of 2006 has ended in acquittal of the petitioner vide judgment, dated 18.12.2017, in accordance with law.

5. The entire exercise shall be completed within a period of eight weeks from the date of receipt of a copy of this order. Any decision decision taken shall be communicated to the petitioner.
