====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 14-05-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in connection with Khagaul P.S. Case No. 244 of 2024 dated 26.07.2024 registered for the offence punishable under Section 304 of the B.N.S. 2023.

3. As per the prosecution case, on 26.07.2024, at about 10.00 A.M., two unknown boys riding on a Motorcycle came and snatched the golden chain from the informant and thereafter they fled away.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in the present case. The petitioner is not named in the F.I.R. His name has surfaced in the present case on his self confession made

Patna High Court CR. MISC. No.29260 of 2025(2) dt.14-05-2025 2/3 before the police in Rupaspur P.S. Case No. 482 of 2024. He was not arrested on the spot. No incriminating article has been recovered from his possession. The petitioner has no concern with the alleged offence. The petitioner has been remanded in the present case from Rupaspur P.S. Case No. 482 of 2024. The charge sheet has been submitted in the present case against the petitioner. The motorcycle number given by the informant does not belong to the petitioner. The petitioner has eleven criminal antecedents in which he is on bail as stated in paragraph no. 3 of the bail application. The petitioner is in custody in this case since 23.08.2024.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well the period of custody, let the above named petitioner, be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-I, Danapur, Patna in connection with Khagaul P.S. Case No. 244 of 2024 with further condition:- I. The petitioner is directed to remain physically present before the learned court
