Petitioner seeks bail in a case registered for the offences punishable under Sections 147,148,149,307 and 302 of the Indian Penal Code and 27 of Arms Act.

Son of the deceased, who was also alongwith the deceased at the time of occurrence, is specific in his statement before the police that the petitioner had caused two firearm injuries to the deceased and the statement is consistent with the medical report in postmortem examination wherein two wounds of entry were found.

I am not inclined to enlarge the petitioner on bail in connection with Hussainganj P.S.Case No.48 of 2018 pending in the court of learned Chief Judicial Magistrate,

Patna High Court CR. MISC. No.29943 of 2019(3) dt.27-09-2019 2/2 Siwan. Hence, prayer is refused.

Since the petitioner is in custody since 05.06.2018, the learned Trial Court is directed to expedite the trial. If needed, the trial of the petitioner be separated and it is expected that it would be concluded within nine months, failing which the petitioner would renew prayer for bail before the learned court below itself which shall pass necessary order.
