1. Heard Mr. Sudhanshu Kumar, learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in a case registered for the offences punishable under Sections 191(2), 190, 126(2), 115(2), 118(1), 109, 303(2), 351(2) and 352 of the BNS.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is in custody since 02.02.2026 and the informant alleges that 13 named accused persons including the petitioner came and Golu assaulted Rameshwar by an iron rod causing injury on head and when he fell Golu repeated the blow causing injury on chest. Further, Arvind assaulted Ritesh by an iron rod causing injury on head and also assaulted on back while Lalji assaulted Ravindra by an iron rod causing injury on head and when he fell, petitioner and Pankaj

Patna High Court CR. MISC. No.32101 of 2026(2) dt.03-07-2026 2/3 assaulted him by lathi indiscriminately on account of which Ravindra became unconscious. It is next alleged that thereafter petitioner again assaulted Ravindra by an iron rod causing injury on head and Manji assaulted Rinku by an iron rod causing injury on head. Further, Pankaj also assaulted Chotu by an iron rod causing injury on head while Sanjay snatched chain of Asha and Priyanshu acted inappropriately with her.

4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is further submitted that from the side of the petitioner Suryapura P.S. Case No. 144 of 2025 has been instituted against the informant and others, as such, the instant FIR is a counterblast. It is next submitted that petitioner is cousin of the informant of Suryapura P.S. Case No. 144 of 2025.

Learned counsel for the petitioner fairly submits that the injury suffered by Ravindra on head has been opined to be grievous in nature but then it is submitted that from perusal of the allegation as alleged in the FIR, it would manifest that informant, initially, alleges that Lalji assaulted Ravindra by an iron rod causing injury on head and thereafter Pankaj and petitioner assaulted him by lathi when he fell and again petitioner assaulted by an irod rod causing injury on head of Ravindra. It is, thus, submitted that Lalji and petitioner both, thus, are alleged to have

It is further submitted that petitioner is not a criminal and allegation of assualt also gets belied by the fact that two accused are alleged to have assaulted Rabindra on head but then only one injury was found. It is next submitted that charge-sheet has been submitted and if the privilege of regular bail is granted to the petitioner, the petitioner will not abscond rather will cooperate in the trial to prove his innocence.

6. Learned A.P.P. for the State opposes the prayer for regular bail of the petitioner.

Considering the submissions made by the learned counsel appearing on behalf of the petitioner, the petitioner, abovenamed, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Trial Court where the case is pending in connection with Suryapura P.S. Case No. 145 of 2025.
